Data & API terms.

These terms are between you and Cars Data, the operator of cars-data.com (“we”). They cover two things: Part A, using the API, the MCP server and the Apify Actor; and Part B, buying a data export and its update subscription. Clauses A6 to A12 apply to both. By requesting an API key, calling the API or paying an invoice for an export, you accept them. Using the website itself is governed by the website terms.

Part A — API, MCP server and Apify Actor

A1. Definitions

  • “Data” — the vehicle specifications, catalogue entries, prices, images and related values we provide.
  • “Output” — the specific API responses you receive for your calls.
  • “Compiled Database” — our structured, normalised, multilingual database and its selection, arrangement, taxonomy, translations and enrichment.
  • “Plan” — the way you access the API: the Free key or paid usage through Apify.

A2. Licence

Subject to these Terms and your Plan, we grant you a limited, non-exclusive, non-transferable, revocable licence to call the API and to use the Output within your own application, website or workflow to display or process vehicle information for your end users. This does not transfer ownership of any Data or of the Compiled Database.

A3. Plans, quotas and fair use

Each Plan has request quotas and rate limits, published on our pricing pages and enforced technically. We may throttle or reject requests that exceed them.

You must not circumvent rate limits, quotas, authentication or metering, including by rotating keys, accounts or IP addresses to exceed a Plan.

The Free Plan is for evaluation, non-commercial projects and low-volume commercial use with attribution (A4). Every Free key is issued after manual review of the request; we may decline a request without giving reasons. One person or organisation gets one key — requesting several keys to exceed a Plan is a breach of this clause.

The MCP server requires an API key like the REST API, and counts against the same quota.

A4. Attribution

Web, app or other visual display: any public display of Output must show a visible “Data by cars-data.com” linking to https://cars-data.com.

AI-agent or conversational use (MCP, tool calls, chat): it is enough that any response using Output names cars-data.com as the source, in the text or in the source list your system shows its user. Removing that source from a response is a breach of this clause.

A5. What you must not do

  • Extract or re-use a substantial part of the Compiled Database, or repeatedly extract small parts in a way that adds up to one.
  • Build, populate or improve a competing vehicle-data product or dataset with the Output; resell, sublicense or redistribute the raw Data as data; or use it to train, fine-tune, evaluate or benchmark any machine-learning or AI model.
  • Bulk-download or systematically harvest the catalogue, for example by enumerating IDs. Caching the Output you actually use is fine; assembling a standalone copy of the database from it is not.
  • Scrape the website instead of using the API.
  • Remove or alter attribution, confidence indicators or last-synced metadata in the Output.
  • Use the Data unlawfully, to infringe others’ rights, or in safety-critical systems.
  • Present the Data as your own or imply endorsement by cars-data.com.

Part B — Data exports and update subscriptions

B1. What you buy

A one-time export of the data modules, languages and subset listed on your invoice, delivered as CSV and JSON files with a field dictionary and a per-field coverage sheet, and — if you subscribe — the updates described in B5.

The export is a snapshot as of its delivery date. Coverage differs by field and is shown in the coverage sheet before purchase.

B2. Internal-use licence

You may use the export inside your organisation, in any number of internal systems, by your employees and contractors working for you: analysis, valuation, pricing, research, product features that do not display the Data publicly, and similar. You may not show the Data to the public.

B3. Public-display licence

Everything in B2, plus displaying the Data to the public on the website(s) or app(s) named on your invoice, with a visible “Data by cars-data.com” attribution linking to https://cars-data.com on every page or screen that shows it. This licence costs 2× the internal-use price.

Display means showing values to people as part of your product. Offering the Data for download, through your own API or feed, or as a dataset is redistribution, not display.

B4. Restrictions under both licences

  • No resale, sublicensing or redistribution of the Data or any substantial part of it, in any form.
  • No use to train, fine-tune, evaluate or benchmark machine-learning or AI models without a separate written agreement.
  • No transfer of the licence to another company, except to a successor of your whole business with our written consent.
  • Clauses A5 and A6 to A12 apply to exports as well as to the API.

B5. Update subscription

Optional. The price is stated on your invoice and billed in advance, annually or quarterly. While it runs we deliver a full snapshot plus a change file (records added, changed and removed, keyed on stable IDs) after each data refresh, at least quarterly. Refreshes are batch updates, not a real-time feed.

You may cancel before the next billing period; already-paid periods are not refunded. When the subscription ends you keep the last delivered export under the same licence. Updates delivered under a subscription carry the same licence as the original export.

B6. Payment and delivery

We deliver after payment of the invoice (bank transfer). Prices are in euros; you are responsible for any VAT or other taxes that apply to you, except taxes on our income.

A6. Ownership and database rights

We and our licensors keep all rights in the API, the Compiled Database, our trademarks, and the structure, taxonomy, translations and arrangement of the Data. You get only the licences granted in these Terms.

We claim protection in the Compiled Database, including any applicable sui generis database right in its selection, verification, arrangement, translation and presentation, independent of any rights in the underlying factual values.

A7. Accuracy — no warranty

The Data is aggregated from multiple sources and provided “as is” and “as available”, without warranties of accuracy, completeness, currency, fitness for a particular purpose or non-infringement.

Individual values can be incomplete, outdated or wrong. Where available we expose a confidence indicator and a last-synced timestamp; do not rely on the Data for decisions that need guaranteed accuracy without checking it independently.

Prices are new-car list prices by model year from a single market, not current market prices, and are not financial or valuation advice.

A8. Third-party data

Some underlying facts originate from third-party sources. We verify, normalise, translate, cross-reference, score and enrich them; the Compiled Database is the product of that work, not a republication of any single source.

We do not represent that your particular use is licensed or non-infringing in your jurisdiction; you are responsible for your own compliance.

A9. Suspension and termination

We may suspend or end your access or licence if you breach these Terms, abuse the service or use the Data unlawfully. On the Free Plan we may also revoke keys on reasonable suspicion of coordinated abuse.

When an API licence ends you must stop using the Output, except Output already lawfully shown within your application. A breach of B3 or B4 ends the export licence, and you must delete the Data.

A10. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for anything arising from the API, an export or these Terms is limited to the greater of the amounts you paid us in the twelve months before the event, or €100.

A11. Indemnity

You will defend and indemnify us against third-party claims arising from your use of the API, the Output or an export in breach of these Terms or the law.

A12. Changes, privacy and law

We may change these Terms, the API and our Plans with reasonable notice on this page; the version and effective date above change with them. Paid periods and delivered exports keep the terms they were bought under.

We collect only the personal data needed to run the service, such as the email for a Free key or an invoice — see our privacy policy.

These Terms are governed by the laws applicable where the operator of cars-data.com is established, without prejudice to mandatory consumer-protection rights where you live.
